Terms of Service

As a client of Affordable Websites Fast, you agree to:

• Provide accurate information: Supply truthful, complete, and current information about your business, services, and brand during the project intake process.
• Own or have rights to content: Ensure all text, images, logos, and materials you provide are either owned by you or that you have explicit permission to use them on your website.
• Respond in a timely manner: Provide feedback, approvals, and requested revisions promptly to keep the project on schedule.
• Use the website lawfully: You agree not to use your website to violate any laws, infringe on others' rights, or engage in harmful, deceptive, or illegal activities.
• Maintain login security: You are responsible for keeping your website login credentials confidential and for all activity that occurs under your account.

Your content: All text, images, logos, and other materials you provide remain your property. You grant Affordable Websites Fast a license to use these materials solely for the purpose of building and maintaining your website.

Our work: The website design, layout, code structure, and any custom development created by Affordable Websites Fast for your project are provided to you for use on your website. Upon full payment, you receive a non-exclusive license to use the completed website.

Third-party components: Your website may include third-party tools, libraries, or integrations (such as hosting platforms, form services, or design frameworks). These remain the property of their respective owners, and their use is governed by their own terms and licenses.

Portfolio use: Affordable Websites Fast reserves the right to showcase your completed website as a portfolio example or case study, unless you explicitly request otherwise in writing at the time of project engagement.

To the maximum extent permitted by law, Affordable Websites Fast shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the website.
• Loss of revenue, profit, data, or business opportunities resulting from website downtime, errors, or security issues.
• Third-party actions, including hacking, unauthorized access, or malicious use of your website.

Maximum liability: Affordable Websites Fast's total liability for any claim related to services provided shall not exceed the total amount paid by you for those services.

Website availability: While we build reliable, professional websites, we do not guarantee 100% uptime or that the website will be completely free from errors. Website performance depends on hosting providers, internet connectivity, and factors beyond our control.

Included revisions: Your project includes a set number of revision rounds as outlined in your project agreement. These revisions allow you to request changes to the design, layout, or content during the build process.

Beyond included revisions: Additional revisions or substantial changes beyond the scope of your original agreement may incur additional fees. We will provide a quote before proceeding with out-of-scope work.

Scope creep: We define project scope clearly at the start. If you request significant additions or changes that materially alter the project (such as adding new pages, complex integrations, or custom functionality), we will discuss revised timelines and pricing.

Service updates: Affordable Websites Fast reserves the right to update or modify our services, pricing, or terms. We will provide reasonable notice of material changes that affect existing clients.

Pricing: All pricing is provided in the project agreement and is in USD unless otherwise stated. Pricing is transparent and does not include hidden fees.

Payment schedule: Payment is typically due as follows:

• 50% due upon project kickoff to secure your start date
• 50% due upon website launch

Accepted payment methods: We accept credit cards, bank transfers, and other payment methods as agreed upon in your contract.

Late payments: If payment is not received by the agreed due date, we reserve the right to pause project work, delay launch, or suspend services until payment is made.

Refunds: Refunds are generally not available once work has begun. If you cancel before the first milestone, a portion of the deposit may be refundable depending on work completed. Cancellations after work has started are non-refundable.

Client termination: If you wish to terminate your project, you must notify Affordable Websites Fast in writing. You remain responsible for payment for all work completed up to the termination date, plus any non-refundable expenses incurred.

Our termination: Affordable Websites Fast reserves the right to terminate a project if:

• Payment is not received by the agreed deadline
• You violate these terms or engage in illegal or harmful conduct
• You request content or services that we cannot ethically or legally provide

Upon termination: You remain responsible for all fees incurred. We will provide you with your content and materials upon request, but the website may not be completed or launched.

Informal resolution: If a dispute arises, we encourage you to contact us directly to discuss and resolve the matter informally before pursuing formal action.

Governing law: These terms and your agreement with Affordable Websites Fast are governed by the laws of the United States, without regard to its conflict-of-law principles.

Jurisdiction: You agree that any legal action or proceeding arising from these terms or your use of our services shall be brought exclusively in the state or federal courts located in the United States, and you consent to the personal jurisdiction of such courts.

Arbitration: For disputes that cannot be resolved informally, both parties agree to attempt resolution through binding arbitration before pursuing litigation, unless otherwise required by law.

Entire agreement: These Terms of Service, along with your signed project agreement, constitute the entire agreement between you and Affordable Websites Fast regarding our services.

Amendments: Affordable Websites Fast may update these terms at any time. Material changes will be communicated to you. Continued use of our services constitutes acceptance of updated terms.

Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No waiver: Failure to enforce any provision of these terms does not constitute a waiver of that provision or any other provision.
